Use our music as a backing track to a spoken-word recording, such as affirmations, hypnosis, guided meditations, and educational recordings. Every audio created with our music must contain a spoken-word audio recording that at least covers half of the music length. The spoken words have to be clearly audible.

Selling the music with a spoken-word recording

Use our music as a backing track to a spoken-word recording and sell as a digital download, audio streaming, or a physical CD. Every product created with our music must contain a spoken-word audio recording that at least covers half of the music length.

Online videos

Use our music in your videos for web video hosting providers such as Youtube and Vimeo. You can collect money doing so if it contains spoken-word audio. If you have the music distributed, you may not use services such as ‘Content ID matching’ and/or ‘Sync. Licensing’ or use services of companies like Audiam that offer tracking software. You may monetize, but only on your own channels and not through intermediaries. Every video created with our music must contain a spoken-word audio recording that at least covers half of the music length.

Live Streaming

You can use our music for various kinds of live video meetings or live streamings, such as Skype, Zoom, and Youtube Live. Every video created with our music must contain a spoken-word audio recording that at least covers half of the music length.

Clients and patients

Use the purchased music during sessions with your clients or patients. For example, use it for a guided meditation, hypnosis, or yoga class.

Apps

Use the purchased music in your app, without the audio being looped and/or repeated automatically. For example, use our music in a guided meditation, your clients can choose to listen to. Also applies to app use: Every audio created with our music must contain a spoken-word audio recording that at least covers half of the music length.

Edit our music

Edit the purchased music if necessary. For example: looping it, cutting it, applying fade-ins, and fade-outs. This also applies for use in your app provided the audio is not being looped and/or repeated automatically.

Add sounds

You may add sounds such as nature sounds or brainwave frequencies. However, you may not add musical instrumentation or vocal melodies. For example, you cannot add a guitar, piano, vocal line, or choir.

2. Credits

When you use our music, you must give credit, with the exception of playing our music in a public place or when using it in a session with your clients or patients.
For example:
“Music composed and performed by Maura ten Hoopen. Licensed by Restful Mind.”

3. Disallowed uses

Selling the music without spoken-word audio recording

You cannot sell, perform, distribute or publish the purchased music without a spoken-word audio recording that at least covers half of the music length.

Remix, mashup, or make vocal versions

You cannot create adaptations like a remix, mashup, or vocal version with the purchased music.

Use our title

You cannot use the same title we use for the purchased music. For example, if you want to use our track ‘Pink Clouds’, you cannot use that title for your project.

Sub-Licensing our music

You cannot sell the purchased music by granting a license to a third party. The music bought can only be used by the licensee.

Sending our music to others

You cannot share/transmit the purchased music with others unless they are part of your business and/or part of the creation of the project that you use the purchased music for.

TV, Games, Commercials & DVDs

You cannot use our royalty-free music for TV, games, commercials, or DVDs. Contact us to discuss the options, this requires a different license.

4. About the license

License duration

This license has no expiry date. Provided that your payment is received in full, you can continue to use the purchased music indefinitely.

One-time payment

Once your initial payment is received you will not have to pay any ongoing fees of any type. Our music is truly royalty-free.

License use

This music license is granted to one person, or to one business entity.

5. Intellectual Property and Copyright

restfulmind.com is owned by Restful Mind (the licensor), a company owned by Maura ten Hoopen. All royalty-free music downloaded from our website is licensed by Restful Mind and is protected under Dutch law and international treaty provisions.

Maura ten Hoopen shall retain the entire right, title, and interest in and to all intellectual property rights associated to Restful Mind music and all copies thereof.

6. Warranty

Restful Mind warrants that:
– The music will be free from defects.
– Restful Mind has the rights and authority to grant you the rights described in this license.
– Restful Mind shall not be responsible to you or any other person for damages, costs, or losses out of your use of the music.
– Restful Mind is not responsible for any damages, costs, or losses as a result of modifications made to the music by you or the context in which the music is used in your work.

7. Unauthorized Use

Any use of the music in a manner not permitted under terms of this license is a violation of copyright. Restful Mind is entitled to end your right to use the music at once upon your violation of the license terms, without prejudice to other legal rights and remedies available which Restful Mind wishes to exercise on a worldwide scale.

At time of termination, you shall stop using the music and shall delete or destroy all copies of the music. This shall not relieve you of paying any related license fees and/or indemnification to Restful Mind. You shall also be responsible for any damages resulting from any unauthorized use, including any claims by a third party.

8. Privacy

Your personal information or e-mail address will not be shared with any other company or person. We don’t keep any financial data; these are processed securely by our e-commerce partners.

9. Refund Policy

Choose your music carefully and try out a preview first. Like most online companies that provide digital services, you can’t get a refund or exchange any product that has already been downloaded. Once you’ve downloaded the music, the purchase is final.
